Welcome to findHVACjobs.com, operated by Remloc Capital, LLC d/b/a findHVACjobs.com ("we," "us," or "our").

These Terms of Service ("Terms") govern your access to and use of findHVACjobs.com, our job board, employer tools, newsletter, content, and related services (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Services.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services.

By using the Services, you represent and warrant that:

• you are at least 18 years old
• the information you provide is accurate and complete
• you will use the Services only for lawful purposes
• if you use the Services on behalf of a company or other entity, you have authority to bind that entity to these Terms

2. Our Services

findHVACjobs.com is a platform that helps connect HVAC professionals and job seekers with employers, recruiters, and job opportunities.

We may offer features including:

• job listings
• employer accounts and job posting tools
• job seeker applications
• newsletter subscriptions and job alerts
• salary, licensing, and career content
• paid employer posting options and related upgrades

We may update, modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. Accounts

Some parts of the Services may require you to create an account.

You agree to:

• provide accurate, current, and complete information
• keep your login credentials confidential
• notify us promptly if you believe your account has been compromised
• accept responsibility for activity that occurs under your account

We reserve the right to suspend or terminate accounts that contain false information, violate these Terms, or create risk for the Services or other users.

4. Employer Terms

If you are an employer, recruiter, staffing firm, or other hiring party, you agree that:

• you will post only legitimate job opportunities
• your job listings will be accurate, lawful, and non-misleading
• you will not post fake jobs, duplicate jobs, commission-only jobs without clear disclosure, or jobs that violate applicable law
• you are responsible for the content of your job listings, screening criteria, interview process, hiring decisions, and compliance with all employment laws
• you will not collect or misuse applicant information for any purpose unrelated to a legitimate hiring opportunity
• you will not discriminate unlawfully in job postings, hiring, screening, compensation, or employment practices

We may remove, edit, reject, or disable any job listing at our discretion if we believe it violates these Terms, creates user risk, or harms the integrity of the platform.

5. Job Seeker Terms

If you are a job seeker or applicant, you agree that:

• the information you submit is truthful and accurate
• you are solely responsible for the content of your resume, profile, certifications, licenses, application materials, and messages
• you understand that employers, not findHVACjobs.com, are responsible for job listings, hiring decisions, interview requests, compensation, workplace safety, employment terms, and compliance with employment laws
• you are responsible for verifying job details before accepting employment

We do not guarantee that any employer will contact you, interview you, or hire you.

6. Payments, Fees, and Subscriptions

Certain Services may require payment, including paid job postings, featured listings, upgrades, or subscription-based employer plans.

By purchasing a paid Service, you agree that:

• you will pay all applicable fees shown at checkout
• you authorize the payment processor we use to charge your selected payment method
• pricing, features, and plan availability may change at any time
• unless otherwise stated, fees are non-refundable once a listing, promotion, or subscription period has begun

If you purchase a recurring subscription, you authorize recurring charges until you cancel. You are responsible for managing or canceling your subscription before the next renewal date if you do not want it to renew.

We may use third-party payment processors, such as Stripe, to process payments. We do not store full payment card information on our own systems.

7. No Guarantee of Results

We do not guarantee:

• that any job listing will receive a certain number of views, applicants, interviews, or hires
• that any employer will fill a position
• that any job seeker will receive an offer
• that any listing or application will remain available for any specific period of time
• that the Services will be uninterrupted, error-free, or always available

Any metrics, examples, or promotional statements on the Services are illustrative only unless expressly stated otherwise.

8. User Content

You may submit or upload content through the Services, including job postings, employer information, resumes, application materials, messages, reviews, and other content ("User Content").

You retain ownership of your User Content. However, by submitting User Content through the Services, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, distribute, and use that User Content as necessary to operate, improve, promote, and provide the Services.

You represent and warrant that:

• you own or control the necessary rights to the User Content you submit
• your User Content does not violate any law, regulation, contract, or third-party right
• your User Content is not false, misleading, defamatory, obscene, infringing, harassing, or unlawful

We may remove or disable User Content at our discretion.

9. Prohibited Uses

You agree not to:

• use the Services for any unlawful purpose
• post false, misleading, fraudulent, or deceptive content
• impersonate another person or entity
• scrape, harvest, mine, or collect data from the Services without our written permission
• use bots, crawlers, or automated tools to access the Services in a harmful or abusive way
• interfere with or disrupt the integrity or performance of the Services
• upload malware, viruses, or harmful code
• attempt to gain unauthorized access to accounts, systems, or data
• use the Services to send spam, unsolicited messages, or mass communications
• reproduce, copy, sell, or exploit the Services except as expressly permitted by us
• use applicant data or employer data for unrelated marketing, resale, lead generation, or other unauthorized purposes

10. Intellectual Property

The Services, including our branding, design, text, graphics, logos, software, content, and overall site experience, are owned by or licensed to us and are protected by intellectual property laws.

Except for the limited right to use the Services under these Terms, nothing in these Terms gives you any ownership or license rights in our intellectual property.

You may not copy, reproduce, modify, distribute, publicly display, or create derivative works from the Services without our prior written permission.

11. Third-Party Services and Links

The Services may contain links to third-party websites, services, tools, payment processors, employer sites, or job application systems.

We do not control and are not responsible for third-party services, content, policies, hiring practices, payment practices, or website availability. Your use of third-party services is at your own risk and subject to the terms and policies of those third parties.

12. Privacy

Your use of the Services is also subject to our Privacy Policy.

By using the Services, you acknowledge that we may collect, use, and share information as described in our Privacy Policy.

13. Termination

We may suspend, restrict, or terminate your access to the Services at any time, with or without notice, if we believe:

• you violated these Terms
• you created risk or possible legal exposure for us or other users
• your use of the Services is fraudulent, abusive, or harmful
• termination is necessary to protect the integrity of the platform

You may stop using the Services at any time.

Sections of these Terms that by their nature should survive termination will survive, including ownership, payment obligations, disclaimers, limitation of liability, indemnification, and dispute-related provisions.

14. Disclaimers

The Services are provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising out of course of dealing or usage of trade.

We do not warrant that:

• the Services will meet your requirements
• the Services will be uninterrupted, secure, or error-free
• job listings, applicants, employer profiles, or other content will be accurate, complete, or reliable
• defects will be corrected
• the Services or servers are free of viruses or other harmful components

15. Limitation of Liability

To the fullest extent permitted by law, Remloc Capital, LLC, findHVACjobs.com, and our officers, owners, employees, contractors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, business opportunities, goodwill, or employment opportunities, arising out of or related to your use of or inability to use the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or related to the Services will not exceed:

• the amount you paid us for the specific paid Service giving rise to the claim in the 3 months before the event giving rise to the claim, or
• $100, if you have not paid us for any Services

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

16. Indemnification

You agree to defend, indemnify, and hold harmless Remloc Capital, LLC, findHVACjobs.com, and our officers, owners, employees, contractors, affiliates, and service providers from and against any claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

• your use of the Services
• your User Content
• your violation of these Terms
• your violation of any law or third-party rights
• your hiring practices, employment decisions, or interactions with applicants or employers

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.

18. Disputes

Any dispute, claim, or controversy arising out of or relating to these Terms or the Services will be resolved in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction and venue of those courts.

Before filing a claim, both parties agree to try to resolve the dispute informally by contacting the other party in writing.

19. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page.

Your continued use of the Services after updated Terms become effective means you accept the revised Terms.
